Lago di Lei (Lombard: Lach de Lei) is a reservoir in the Valle di Lei, powering the Hinterrhein storage power stations. The reservoir is entirely in Italy, the barrage was built on Italian territory. Actually in map there is a wrong border with Switzerland (municipality of Ferrera, Grisons) because on 1955 , after diplomatic talks, the Italian plenipotentiary VISENTINI, did not sign the exchange of correspondence with his Swiss counterpart, as at the time there was still prison for those who violated art. 1 of the Italian forestry law.[1] The dam is operated by Kraftwerke Hinterrhein. The waters of the lake are the only waters in Italian territory that drain to the North Sea, being part of the Rhine's drainage basin. Other waters of Italy that do not flow to the Mediterranean Sea are found in the valley of Livigno, valley of Sexten, Puster Valley east of Innichen, and most of the waters of the municipality of Tarvisio east of Sella Nevea: all these waters flow to the Black Sea through the basin of the Danube.

The lake is part of the collective domain, of 5000 hectares, of the mountain family community of the Val di Lei 's alps and pastures, whose property rights and possession are managed and administered by the body with legal personality under private law: 'Soc. Val di Lei'.

The lake is currently leased (for 80 yrs.) to the Swiss electricity company KHR under a negotiated agreement in favour of the third party (Decreto del Presidente della Repubblica, Div. X, n. 9033, 21 December 1955).[2]

There is a dispute between 'Soc. Val Di Lei', Italian Republic and Swiss Confederation, as boundary on maps does not correspond to legal situation of the private property, which also includes the dam.

Basically, the Convention on Borders is null and void because it is contra-legem. In fact, the private property of the mountain family community cannot be divided, because by law it cannot be divided or alienable and it is not prescriptive, with perpetual agro-forestry-pastoral use, moreover, there is no reciprocity on agricultural land with Switzerland for a possible compensation with Swiss territory.[3]

Lake, technically, is a reservoir that uses waters of Reno di Lei stream to produce electricity in Switzerland.[4]
